Ravindra Kumar G. Rengasamy
Ravindra’s practice focuses on employment law and industrial relations, both in the aspect of litigation and advisory work. He often advises on redundancy and retrenchment and the obligations arising therefrom, and reviews and drafts mutual separation agreements, employment contracts, employee handbooks and collective agreements. Litigation in the courts includes representing clients in cases pertaining to unfair dismissal, retrenchment and constructive dismissal, as well as in judicial review applications, injunction applications and civil claims pertaining to issues such as breach of non-disclosure and non-solicitation clauses by former employees.
Ravindra has appeared at all levels of the Malaysian court hierarchy in dealing with employment cases.
A 2017 victory in the Court of Appeal was for long-time client, Baker Hughes, in a claim for alleged wrongful termination of a Consultancy Agreement. Ravindra won the day for Baker Hughes again in a more recent case in the Industrial Court, where the central issue was whether the issuance of a work permit and payment of taxes would create an employer-employee relationship between a local company and an employee who is employed by a foreign entity and assigned/seconded to Malaysia.
