Mark Yu Kee La Brooy
Insolvency litigation being his principal practice area, Mark acts primarily for liquidators, receivers, lenders and financiers, ﬁnancial consultants and other recovery turn-around specialists. At the same time, he has also acted for distressed companies in respect of debt restructuring exercises involving large numbers of unsecured creditors. He also advises financial institutions on matters relating to enforcement of security, judicial management, corporate rescue and schemes of compromise and arrangement. Issues usually encountered include those relating to undue/fraudulent preferences, priority claims to land and other assets, asset dissipation, schemes to defraud creditors, minority oppression and breach of ﬁduciary duty.
Mark also appears in courts regularly in respect of land acquisition matters. He acts for land owners and for parties seeking to acquire land in both judicial review actions and proceedings before land reference courts.
More recently, Mark has branched out into the new area of Competition law, and has represented clients in proceedings before the Competition Commission of Malaysia.
