Insolvency litigation being his principal practice area, Mark advises and appears in Court for creditors, stakeholders of distressed companies and insolvency specialists on issues concerning corporate rescue, schemes of arrangement, judicial management, informal debt restructuring and liquidation.
When the airline industry was severely affected by the Covid-19 global pandemic, Mark was in Court representing creditors of AirAsia X Berhad in respect of its proposed scheme of arrangement pursuant to the Malaysian Companies Act 2016.
In addition, Mark was involved in advising on the Malaysian law aspects of the debt restructuring arrangement of Malaysia Airlines and its related companies, which arrangement related to their operating and finance leases as well as associated aircraft and engine maintenance contracts. This matter was significant as the application for the arrangement was made to the High Court in England and not a High Court in Malaysia and was the first case of a Malaysian corporate group applying to the English High Court under new English companies legislation to implement a debt restructuring arrangement. Our clients were the foreign creditors of the Malaysian applicants.
Mark is also experienced in the area of Competition law, having represented clients in proceedings before the Malaysia Competition Commission and the Competition Appeal Tribunal.
The 2023 and 2024 editions of The Legal 500 Asia Pacific named Mark as a Recommended Lawyer and a Key Lawyer respectively.
