Dianne is a litigator focused in civil and commercial disputes. She has successfully led trials at both Subordinate Court and High Court level. She is also actively involved in arbitration proceedings.

Dianne has experience in a diverse range of disputes including those involving government-linked and public listed companies and foreign clients in industries such as mining, technology and/or construction and infrastructure and in issues involving, among others, product liability, negligence, nuisance, trespass, economic torts and/or shareholder disputes. Dianne also advises on information technology disputes, having acted in disputes relating to information and communication technology projects, involving system implementation failures and non-performance. Dianne’s work often involves technical and expert-driven elements. She has conducted trials and arbitrations involving expert evidence across multiple disciplines, including mechanical, civil and geotechnical engineering, quantity surveying and agronomy. Her experience also covers technical disputes, river contamination, soil erosion and/or structural stability relating to mining operations.

Dianne recently successfully defended a mining company against claims of encroachment by a landowner which involved novel issues of interpretation of the National Land Code 1965 relating to river encroachment.

  • assisting in a matter involving claims by a landowner for nuisance and negligence arising from flooding allegedly caused by mining operations.
  • assisting in a matter involving multiple claims by the landowner of the site adjacent to the project site involving alleged contractual and tortious breaches.
  • assisting a vessel owner in defending wrongful termination/breach of contract claims by a works contractor.
  • assisting in a matter involving a marine fuel supplier in regard to a claim by a vessel owner for negligence and breach of contract in relation to the supply of fuel.
  • assisting a government-linked company in defending an application for judicial review relating to the rejection of an application to renew a permit relating to rock materials. 
  • assisting state-owned enterprises in defending claims of conspiracy and unlawful interference by a mining contractor.
  • assisting in a matter involving an investment company in defending claims by an individual made pursuant to a disputed letter of undertaking.
  • assisting in a matter involving an investment company in a claim against individuals for breaches of fiduciary duty, breach of trust, fraudulent misrepresentation and conspiracy relating to monies transferred to a foreign bank account. 
  • assisting a government-linked company in defending a claim for misrepresentation and breach of contract relating to a collaboration agreement. 
  • assisting a company in a claim regarding non-payment for delivered sands.
  • assisting a professional service provider in disputes involving alleged breaches of share sale and service agreements which involved, amongst other things, Anton Pillar relief.
  • represented both claimants and respondents in applications to set aside and/or enforce arbitration awards.
  • acted for and against vessel owners in relation to a variety of disputes, including ship arrest.
