In sickness and in health – Malingering and Medical Board Out

The Industrial Court in O.Y.L. Condair Industries Sdn Bhd v Malachelvi a/p Veeman [1993] 1 ILR 280 held as follows:

“This Court can understand the Company’s  predicament when an employee falls sick too often. It can be a constant source of irritation and frustration. For the management this is part and parcel of the labour force. Any worker is likely to fall sick at times and there may be unfortunate deaths and illness in his family. No employer should expect that his employees will never fall ill because it is not a natural process however healthy an employee may be he would sometimes be taken ill. Therefore if a work man is sick, he is entitled to sick leave due to him.”

Is an employer required to take a medical certificate produced by the employee at face value? Or is he entitled to go behind the medical certificate to enquire further? What if an employee falls ill too often and for too long – would this justify a medical board out?
