In light of the Movement Control Order issued by the Government of Malaysia on 16 March 2020, the physical office of the Intellectual Property Corporation of Malaysia (“MyIPO”) is temporarily closed from 18 to 31 March 2020 (the “Period”).
1. Online System Remains Open
MyIPO’s online system remains accessible and online filings can continue for Patents and Industrial Designs whereas for Trademarks, only the new filing for national application module is available online. International Trademark filings through the Madrid System are suspended during the Period and will resume on 1 April 2020.
2. Suspension of Copyright Voluntary Notification Applications
Applications for Copyright Voluntary Notifications are also suspended during the Period and will resume on 1 April 2020.
3. Extension of Office Action Deadlines to 30 April 2020
Deadlines for all office actions issued by MyIPO (for Patents, Industrial Designs and Trademarks), including appeals, oppositions and payments, due during the Period are extended until 30 April 2020.
4. Extension of Payment Deadline for Renewals for Patents and Industrial Designs to 1 April 2020
Renewal deadlines for Patents and Industrial Designs registrations falling during the Period are extended to 1 April 2020.
5. Extension of Payment Deadline for Renewals for Trademarks to 30 April 2020
Renewal deadlines for Trademark registrations expiring between 27 December 2019 and 27 March 2020 are extended until 30 April 2020.
6. Trademark Applications with Priority Deadlines (during the Period) can be filed on 1 April 2020
Trademark applications with priority deadlines during the Period, which could not be filed online, can be filed manually on 1 April 2020 and still be entitled to the priority date claimed.
7. Rescheduling of Hearings
All hearing matters (for Patents, Industrial Designs and Trademarks) scheduled during the Period will be rescheduled to a later date.
